1. Acceptance of Terms

By creating an account or using ThankStars, you agree to these Terms, our Privacy Policy, and any additional terms that may apply. If you do not agree to these Terms, do not use our service.

2. Description of Service

ThankStars is a platform that helps open source maintainers engage with and thank their GitHub stargazers. Our service integrates with GitHub to track star events and facilitate communication with your community.

3. Account Registration

To use ThankStars, you must:

• Have a valid GitHub account
• Authorize ThankStars to access your GitHub account
• Provide accurate and complete information
• Be at least 13 years of age

You are responsible for maintaining the security of your account and for all activities that occur under your account.

4. Acceptable Use

You agree not to use ThankStars to:

• Violate any laws or regulations
• Send spam, unsolicited messages, or harass users
• Impersonate others or misrepresent your affiliation
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorized access to any part of the service
• Use automated means to access the service without permission
• Violate GitHub's Terms of Service or Acceptable Use Policies
• Send messages that are abusive, threatening, or contain hate speech

5. GitHub Integration

ThankStars integrates with GitHub's APIs. Your use of GitHub is governed by GitHub's own terms and conditions. We are not responsible for GitHub's availability, changes to their API, or any actions taken by GitHub regarding your account.

6. Subscriptions and Payments

Free Tier

We offer a free tier with limited features. Free accounts are provided "as is" and may be subject to usage limits.

Paid Subscriptions

Paid plans are billed in advance on a monthly or annual basis. Prices are subject to change with 30 days notice. Payments are processed through Stripe or GitHub Marketplace.

Refunds

We offer refunds on a case-by-case basis. Annual subscriptions may be eligible for prorated refunds within 30 days of purchase. Contact support@thankstars.com for refund requests.

7. Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide partial refunds for unused portions of a billing period unless required by law.

8. Intellectual Property

ThankStars and its original content, features, and functionality are owned by ThankStars and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to your content. By using our service, you grant us a license to use, store, and process your content solely for the purpose of providing the service.

9. User Content and Messages

You are solely responsible for all content you create, send, or transmit through ThankStars, including thank-you messages to stargazers. You agree that your messages will:

• Comply with all applicable laws
• Not contain spam or misleading content
• Not violate any third-party rights
• Not contain malicious links or code

We reserve the right to remove content that violates these Terms or is otherwise objectionable.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the service. We may modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice before discontinuing core features.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THANKSTARS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO THANKSTARS IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless ThankStars and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of another party.

14. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the service will cease immediately. You may terminate your account at any time by contacting us or through account settings.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on our website or sending you an email. Your continued use of the service after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, you agree to submit to binding arbitration in accordance with the rules of the American Arbitration Association.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
